WAIVER & RELEASE OF LIABILTY
By visiting THE METHOD PILATES, LLC (the “Company”) or communicating with us via email, you agree to receive electronic communications from us. These communications may be sent by email or posted on our website. You acknowledge that all agreements, notices, disclosures, and other messages we send electronically fulfill any legal requirements for written communication.
By registering for and/or participating in THE METHOD PILATES, LLC’s classes, activities, and programs, and by using our facilities, premises, and equipment (collectively referred to as “Classes and Facilities”), you understand and accept that indoor Pilates, exercise, and use of equipment carry inherent risks. These activities may result in injury. It is important to note that certain exercises or activities may cause harm if not done correctly. You must follow all provided instructions and guidelines at all times.
In exchange for being allowed to participate in and access the Classes and Facilities at THE METHOD PILATES, LLC, as well as any associated fees, you (1) accept full responsibility for any injuries or damages you may sustain or exacerbate while participating in or using the Classes and Facilities, (2) waive, release, and forever discharge THE METHOD PILATES, LLC, its officers, agents, members, employees, representatives, and any other associated parties from any claims, rights, or liabilities related to injuries or damages to your person or property from your involvement in THE METHOD PILATES, LLC activities, and (3) confirm that you have no medical or physical conditions that would prevent you from using THE METHOD PILATES, LLC’s Classes and Facilities or put you at risk, and that you have not been advised by a doctor to avoid such activities.
Furthermore, if THE METHOD PILATES, LLC staff determines that you may be at physical risk while using the Classes and Facilities, you will be denied access until you provide THE METHOD PILATES, LLC with a letter from your doctor (at your own cost), specifically addressing the concerns and confirming that THE METHOD PILATES, LLC’s concerns are unfounded.
Additionally, you acknowledge that there is an inherent risk of exposure to COVID-19 in any public space where people gather. COVID-19 is highly contagious and can cause severe illness or death. By visiting THE METHOD PILATES, LLC, you voluntarily assume all risks associated with potential exposure to COVID-19.
THE METHOD PILATES, LLC may take photographs and recordings of you during your participation in activities or while using our facilities. These images and recordings may be published and distributed on our website and social media channels. By agreeing to these terms, you consent to the use of such photographs and recordings for promotional purposes.
BOOKING POLICY
Classes at THE METHOD will be available to book 7 days in advance. To book a class, you must have valid class credits and/or an active membership with a credit card on file.
CHECKING IN
When you get to the studio, we’ll need you to check in for class to ensure your spot is reserved. Please tell your instructor you are present so they can check you in. We hold a 5 minute grace period for clients who are running late.
CANCELLATION POLICIES
You can cancel yourself out of class via our website or by calling us at the studio up to twelve (12) hours before class begins.
If you booked using a class credit and cancel after the designated window, you will forfeit the class credit.
If you booked through a membership and cancel after the designated window, you will be charged $15 late cancellation fee.
NO-SHOW POLICIES
If you booked using a class credit and no-show, you will forfeit the class credit.
If you booked through a membership and no-show, you will be charged $25.
WAITLIST POLICY
Each client is responsible for their placement on the waitlist. If you get into class from the waitlist, the same late cancellation and no-show policies apply, so please be aware of those policies.
MODIFICATIONS TO THE SERVICES & PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
RETURN AND EXCHANGE POLICY
All class credits are final sale. No refunds.
After the three (3) months commitment period, you can cancel a membership anytime, but no prorated refunds will be available. The client is responsible for keeping track of expiration and/or auto-renewal dates. If you wish to terminate your memebership, you must let us know 48 hours in adavnce of your next billing cycle.
All sales are final on retail products.
MEMBERSHIPS
By creating an account and purchasing a membership, you authorize THE METHOD, on a recurring basis, to automatically charge the debit or credit card account specified on the account for monthly payments due on my auto-renewal plan associated with my account. These charges will not exceed the amount shown on my auto-renew contract and/or in connection with cancellation fees according to THE METHOD cancellation policy.
WHAT TO EXPECT IN CLASSES AT THE METHOD
THE METHOD offers high- intensity, low-impact resistance training on a machine. You will utilize the machine and its accesories during the workout. Music may contain explicit language.
Prior to class starting, please let your instructor know if you have any existing injuries, pregancy, or any other body related concerns so they can modify accordingly.
PRIVACY STATEMENT
We at THE METHOD are committed to protecting your privacy. This privacy policy outlines the type of information we receive and collect when you use the features on our website and some of the steps we take to safeguard the information. We do not sell your information to anyone.
COLLECTION OF INFORMATION
We collect personally identifiable information, such as names, phone numbers, postal addresses, email addresses, credit card information, and etcetera, when it is voluntarily submitted by our members and/or visitors. If you use this website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept sole responsibility for all activities that occur under your account or password.
Registration of minors (ages 12-18) must be completed in person at one of our studios with a parent or legal guardian present. THE METHOD does not seek or share personal information from minors through this website.
Your personally identifiable information is kept secure. Only authorized employees, agents, and contractors who have agreed to keep information secure and confidential have access to this information. All emails, phone calls, mobile text messages, and newsletters from this site allow you to opt out of future marketing communication. We use industry-standard efforts to safeguard the confidentiality of your personal information, including the use of firewalls and secure sockets layer software where appropriate. We do not sell your information to anyone.
THE METHOD reserves the right to refuse, terminate accounts, remove or edit content, or cancel orders at its sole discretion.
When you visit THE METHOD or send emails to us, you are communicating with us electronically and, therefore, consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
By signing up for and/or attending classes at THE METHOD, events and using THE METHOD’s equipment, you hereby agree that there are certain inherent risks and dangers in the workout and exercise and in using our facilities and exercise equipment. Please keep resistance on the machine at all times. In consideration of being allowed to participate in and access the classes and equipment provided by THE METHOD, in addition to the payment of any fee or charge, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the classes and equipment, (2) waive, release and forever discharge THE METHOD, its officers, agents, members, employees, representatives, and all others from any and all responsibility, claims, rights, causes of action and/or liability from injuries or damages to your person or property resulting from your participation in and use of the classes and equipment, and (3) represent you have no medical or physical condition which would prevent you from attending and/or using any of THE METHOD and equipment and/or put you in any physical or medical danger and have not been instructed by a physician not to do so. In addition, if, in the opinion of THE METHOD staff, you would be at physical risk using THE METHOD’s classes and equipment, you will be denied access to THE METHOD until you present an opinion letter from your medical doctor, at your sole cost and expense, specifically addressing THE METHOD’s concerns, and stating that THE METHOD’s concerns are unfounded.
INTELLECTUAL PROPERTY RIGHTS
Use of the graphics, logos, designs, page headers, button icons, scripts are service marks, trademarks, etc., on this website without the prior written permission of THE METHOD is strictly prohibited.
DISCLAIMERS
In no event shall The Method – Pilates LLC dba THE METHOD, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (1) errors, mistakes, or inaccuracies of content, (2) personal injury, illness or property damage, of any nature whatsoever, resulting from your access to and use of our website, (3) any unauthorized access to or use of our secure servers an/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from our website, (5) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our site by any third party and/or (6) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the The Full Routine website, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
You specifically acknowledge that THE METHOD shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.
The Method- Pilates LLC dba THE METHOD may revise these terms and conditions by updating this posting. By using this Website, you agree to be bound by any such revisions and should, therefore, periodically visit this page to determine the then-current Terms and Conditions.
